TERMS & CONDITIONS:-
1. Prices have been calculated based on the specifications and sizes quoted, any variation in the sizes, design, and quantities will impact the prices.
2. Silicon shall be applied for the gaps up to 5 mm only, additional filling shall be charged extra as per the requirement.
3. Civil works are not included in the scope. All such works will need to be done by the builder.
4. The builder will need to provide the necessary logistic support at their costs, these services will include
a. Scaffolding
b. Lockable safe storage space
c. Electricity points on each floor
d. Material lift for the lifting of material
5. The windows will be supplied and installed by floor, starting from the top-most floor working downwards.
6. The time for the supply of windows after taking final measurements will be 4 weeks.
7. The rates are based on the current statutory taxes, duties, and levies. Any change in statutory taxes, duties and levies will be passed onto the builder.
"TERMS & CONDITIONS" (Annexure 2)
1. CONTRACT:
1.1. Customer should confirm the techno commercial details viz: Billing details (Name/Address), Delivery Address, Elevations, Fabrication Sizes, Glass Specifications, Opening Direction, Fittings and Price etc. The Products & Doors will be manufactured according to the specification as approved by the customer in this schedule.
1.2. The sizes mentioned in the quotation are the Final Fabrication Sizes of the products.
1.3. Elevation shown in the drawings are as viewed from inside the room by default.
1.4. In case customer wants to revise the product specifications, it may require separate survey which will be chargeable. New price offer will be made as per revised specifications.
1.5. Continuous development is an ongoing process; hence there could be a minor variation in product's design received by customer. This wont affect the functionality of the product in any way.
1.6. Glass is sourced from authorized glass processors/manufacturers. Processed glass may have some inherent distortions within tolerance limits due to the processing techniques which are unavoidable. In such cases the dealer is
not liable to replace it.
1.7. Order once placed cannot be cancelled as the products are customized according to customers site conditions & requirements. In such case any amount paid in advance will not be refunded.
1.8. At the time of survey, if the site is not ready for providing products and/or there is a significant hindrance in providing the products, the dealer reserves the right to cancel the order by refunding any advance received in full.
1.9. At the time of survey, if actual sizes vary from the sizes provided in the quote, the following conditions will apply
1.9.1. If actual size is smaller than the size provided in the quote, the value of the product will remain the same
1.9.2. If the actual size is larger up to 5% over the size provided in the quote, the value of the product will remain the same
1.9.3. If the actual size is larger than 5% of the size provided in the quote, the rate per sq.ft. would be applied to the actual size of the produ
1.10. Terms & conditions mentioned in this document will be final. Any points discussed/agreed verbally between Dealer & customer will not be considered valid.
2. Pricing:
2.1. Taxes other than mentioned, if applicable, shall be extra as per actual.
2.2. Taxes are subject to the prevailing Tax structure in India at the time of dispatch. We reserve the right to change Taxes as
applicable at the time of dispatch.
3. Payment:
3.1. The customer shall pay 50% advance against booking of the order, 40% at the time of submission of proof of
manufacturing and 10% at the time of delivery & installation.
3.2. In case the customer fails to make payment according to terms as under 3.1, an interest at the rate of 18% p.a. on the outstanding shall apply.
4. Delivery
4.1. Standard delivery period for windows shall be
7.3. If required, electricity connection & portable water facility would be provided by the customer, free of charge at the place of living for Installation worker.
7.4. Electricity connection, wherever Installation is carried out, shall be provided free of charge.
4.1.1. White colored products up to 4 weeks from the date Of receipt of 50% advance payment along with confirmed order (section 9).
4.1.2. Wood finish (Laminated) products the standard delivery period up to 8 weeks from the date of advance payment & Confirmed order.
4.1.3. In case of products having special/processed glass the delivery time may be more than 6-8 weeks and shall be intimated by the dealer.
4.1.4. Special modules such as Sliding Folding, Lift & Slide, Tilt & Slide, etc. will depend upon availability of the material & will be informed at the time of Confirmation. Tentative delivery time for such modules will be 8 weeks.
4.1.5. In the eventuality of delay in delivery of products greater than 2 weeks from the above specified timelines, the customer may cancel the order and seek full refund of any amount paid.
4.2. If the products are not picked up after 7 days of informed dispatch date, the dealer shall be entitled to levy applicable warehouse charges in the amount equal to 2% of the gross invoice value per week. This amount needs to be paid prior to the dispatch of those products as and when takes place. If the products are not picked up for more than 45 day after intimated delivery date then the dealer reserve the rights to forfeit the advance money & recover all costs & incidental expenses.
4.3. The dealer will not be liable for any delay which arises from Force Majeure reasons and causes beyond our control such as fire, civil disturbances, government restrictions, pandemic, natural disasters & similar reasons.
4.4. The freight charges mentioned in the quotation are for complete order in single lot only. If customer needs deliveries in more than one lot, additional freight charges shall be applicable. In such cases full load vehicle charges will be applicable even for smaller quantity of products and will be payable as per actuals.
4.5. Once products are delivered at site, customer will be responsible for safety and security of material. In case of any damage or loss of products, replacement cost for the same shall be borne by the customer. The dealer will not be responsible for any inherent delay in arranging such replacement material.
4.6. Any permission required for supply, installation of product from local authorities, housing society will have to be arranged by customer in time.
4.7. E-way bill (if applicable) is to be provided by the dealer.
5. Claims on Delivery:
5.1. The Customer shall:
5.1.1. If actual size is smaller than the size provided in the quote, the value of the product will remain the same
5.1.2. If the actual size is larger up to 5% over the size provided in the quote, the value of the product will remain the same
6. Risk:
6.1. All risk of loss or damage of the products after delivery shall pass on to the Buyer according to Ex-Works sale by the dealer.
7. Installation:
7.1. In case the Installation is delayed due to an issue with site conditions or any other reason on site, the customer would be required to pay the applicable daily charges of the installation team. The charges will be as following:
7.1.1. Out of Station site: INR 3000/- per person per day.
7.1.2. Local: INR 1000/- per person per day. Taxes on the charges would be extra. The charges would be payable 100% in advance before restart of the Installation work
on site.
7.2. The customer shall provide a lockable place & a security arrangement for storage of delivered material free of cost. The customer would be wholly responsible for damage, if any, caused to products due to improper storage or installation delay after delivery.
7.5. Scaffolding, if required, would be provided free of cost by the customer.
7.6. If products required to be lifted from outside, charges for pulley or suitable arrangement to lift the products will be borne by the customer. In such cases if grill is installed it will have to be removed & reinstalled by customer at their own cost.
7.7. Customer would take all necessary social, local authorities & housing society's permission/s for product lifting activities.
7.8. Customer should ensure that there is convenient, easy access for material & installation team without any hindrance for installation of product at site.
7.9. By Default procedure products will be fixed 20mm inside from the outer edge of the sill. For the placement of products at other than default position, request should be given by the customer in writing to the dealer. In case the Step is provided on sill the product will be placed against the step.
7.10. If customer wants to fix the grill independent of the window, the same should be informed before confirming the order. Fixing of grill does not come under the scope of installation. Customer will have to arrange it separately. The dealer will provide assistance in designing the same if required. Please ask for guidelines for fixing the grill from our representative.
7.11. The dealer will not be responsible for cleaning of cement, plaster or any other construction material fallen on the product or glass. The dealer will not be responsible for any damage to product or problems in functioning of the product arising out of such foreign materials.
7.12. The protection tape on the profile sections will be removed at the time of installation. If customer wants to keep it on the profiles for some reason then he/she must ensure that it is
removed within 2 months from the date of installation. After this period the tape may not come off easily.
7.13. Ongoing operation of products must be followed as mentioned in User manual. Link: www.nclveka.com/manual.pdf.
8. Offer Validity:
8.1. This offer is valid for 7 days.
9. Order confirmation:
9.1. The customer shall place the order along with
9.1.1. Copy of quotation duly signed on every page including annexures 1 & 2
9.1.2. Advance payment.
9.2. Order shall be processed, only if all information under sr. no.9.1.
10. Liability:
The Dealers liability under this Agreement is limited to its obligation to supply products in accordance with the terms and conditions of accepted orders. In no event shall Dealer be liable to customer or to anyone claiming through customer for loss, damage, or delay resulting from failure on the part of Dealer. The Dealer shall not be liable for consequential damages, and in no case the liability of Dealer shall exceed the price of the products sold.
